Rental Agreement
This agreement is made between Marina Diamond (hereinafter referred to as “the Company”) and the individual (hereinafter referred to as “the Renter”) who agrees to the terms and conditions by checking the acceptance box on the Company’s website.
1. General Requirements
1.1. All renters must present a valid Pleasure Craft Operator Card (PCOC) at the time of rental. The PCOC is mandatory for operating a personal watercraft (jet ski), boat, or yacht in Quebec.
1.2. Renters must be at least 18 years old to rent and operate a jet ski, boat, or yacht.
1.3. Paddlecraft renters must be at least 18 years old.

2. Proof of Competency
2.1. Renters must provide their PCOC upon request. A photocopy or digital copy of the PCOC is acceptable.
2.2. The name on the PCOC must match the renter’s government-issued photo identification.
3. Safety and Operating Rules
3.1. Renters must adhere to all local, provincial, and federal boating laws and regulations, including those specific to Quebec.
3.2. All operators and passengers must wear a Canadian-approved life jacket or personal flotation device (PFD) at all times while on the jet ski, boat, yacht, or paddlecraft.
3.3. Operating any watercraft under the influence of alcohol or drugs is strictly prohibited.
3.4. Renters must operate the watercraft in a safe and respectful manner, maintaining a safe distance from other watercraft, swimmers, and obstacles.
4. Liability and Insurance
4.1. The Renter assumes full responsibility for any damage to the jet ski, boat, yacht, paddlecraft, or other property, and any injury to persons arising from the use of the watercraft during the rental period.
4.2. The Renter agrees to indemnify and hold harmless Marina Diamond (9445-1911 QC Inc), its owners, and employees from any claims, damages, or expenses resulting from the rental and operation of the watercraft.
4.3. The Company is not liable for any injury, loss, or damage to the Renter or any third parties arising from the use of the rented watercraft. The Renter assumes all risk and responsibility.
5. Rental Period and Fees
5.1. The rental period will be clearly specified at the time of booking, including the start and end dates and times.
5.2. Late returns will incur additional charges as specified in the rental agreement.
5.3. The Renter agrees to pay a deposit prior to renting the watercraft:
- $1000 for jet skis
- $150 for boats
- No deposit required for yachts and paddlecraft
5.4. The security deposit may be required and will be refunded upon the safe and timely return of the watercraft, provided there is no damage.
6. Responsibility for Damage
6.1. The Renter agrees to be fully responsible for any and all damage to the rented watercraft during the rental period. Any damage incurred will be assessed and the cost of repairs will be deducted from the deposit. If the cost of repairs exceeds the deposit amount, the Renter agrees to pay the additional costs.
7. Cancellation Policy
7.1. Cancellations made prior to the rental date as per the booking on www.marinadiamond.ca will receive a full refund.
7.2. Cancellations made within the specified time frame of the rental date as per the booking on www.marinadiamond.ca will be subject to a cancellation fee specified on the website.
8. Environmental Considerations
8.1. Renters must respect the natural environment and avoid sensitive areas, including wildlife habitats and protected zones.
8.2. Any waste or garbage generated during the rental period must be properly disposed of.

9. Terms and Conditions
9.1. The Renter must operate the watercraft in a safe and responsible manner at all times.
9.2. The Renter must comply with all local laws and regulations regarding the operation of the watercraft.
9.3. The watercraft must not be used for any illegal activities.
9.4. The Renter must wear appropriate safety equipment, including a life jacket, at all times while operating the watercraft.
10. Boat Release of Liability Form
10.1. The Renter acknowledges that the use of the watercraft involves inherent risks, including but not limited to the risk of personal injury or death, and damage to property.
10.2. The Renter releases, waives, discharges, and covenants not to sue Marina Diamond, its owners, officers, employees, and agents from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by the Renter, or to any property belonging to the Renter, whether caused by the negligence of the Company or otherwise, while participating in such activity, or while in, on, or upon the premises where the activity is being conducted.
10.3. The Renter assumes full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by the Renter, or any loss or damage to property owned by the Renter, as a result of being engaged in such an activity, whether caused by the negligence of the Company or otherwise.
10.4. The Renter agrees to indemnify and hold harmless the Company from any loss, liability, damage, or costs, including court costs and attorney fees, that they may incur due to the Renter’s participation in the activity, whether caused by the negligence of the Company or otherwise.
11. Acknowledgment and Acceptance
11.1. By checking the acceptance box on the Company’s website, the Renter acknowledges that they have read, understood, and agree to all terms and conditions outlined in this agreement.
11.2. The Renter confirms that they possess a valid Pleasure Craft Operator Card (PCOC) and will carry it during the rental period.
